Lifecycle of a Case: Overview of Pre-Trial Process

This dynamic course provides attorneys with a comprehensive understanding of the lifecycle of a litigation matter, starting from its inception through to trial. The curriculum covers the fundamentals of litigation work, demystifying each phase's complexities while equipping participants with practical knowledge and skills. The stages include client intake and initial case analysis, pleadings, discovery, pretrial motions, and settlement discussions. The course will briefly touch on trial and post-trial procedures to provide the full context necessary to understand the pre-trial strategies covered in the series.

The course begins with insights into client intake and initial case analysis, guiding participants on effectively evaluating the merits of a case. It then dives into the pleadings, educating participants on how to draft complaints, answers and counterclaims, and motions to dismiss, among others. The discovery phase is explored in-depth, with focus on interrogatories, depositions, requests for admissions, and document production processes. Participants will also address pretrial motions, including motions summary judgment motions.

The curriculum prepares attorneys in years 1-2 to capably navigate and understand the entire litigation process, promoting their growth into competent litigators.

Upon completion of this course, participants will be able to:  

  • Identify and explain the key procedural and strategic components at each stage of a civil litigation matter - from the filing of a complaint to its conclusion through settlement, dismissal, or trial.
  • Analyze and evaluate different strategies appropriate to each stage of a civil litigation matter, and identify the most effective approach based on case specifics.
  • Demonstrate an understanding of how to manage a civil litigation matter through all its stages effectively, including decision-making, drafting, and communicating with clients and opposing counsel.
